Abstract

This research paper presents a comprehensive and analytical study of the historical evolution of Usul al-Fiqh (Principles of Islamic Jurisprudence) and its pedagogical dimensions within the traditional educational framework of the Subcontinent. The primary objective of this study is to trace the developmental stages of jurisprudential codification, originating from the Prophetic era, progressing through the periods of the Companions (Sahabah) and Successors (Tabi'un), and reaching its academic zenith during the golden age of the jurists (Fuqaha). Furthermore, the paper delves into the unique academic landscape of the Subcontinent, highlighting how local scholars initially focused on writing commentaries and glosses on classical texts. In this context, a detailed critical commentary is provided on the selected textbook curriculum of Dars-e-Nizami, including Usul al-Shashi, Usul al-Bazdawi, Muntakhab al-Husami, Al-Tawdih wa al-Talwih, Nur al-Anwar, and Musallam al-Thubut. This study underscores how these pedagogical texts serve as a monumental intellectual heritage (Turath) of the region, fostering jurisprudential acumen and legal expertise among students for centuries. Utilizing a historical and descriptive methodology, this research establishes the academic significance of the Subcontinent's jurisprudential legacy in the contemporary era.
