Urdu Language in the Judicial System: Linguistic Imperatives, Structural Challenges and Practical Solutions
Abstract
This paper explores the judicial and linguistic imperative of implementing Urdu as the official language within the judicial and administrative framework of Pakistan. Grounded in Constitutional mandates—specifically Article 251—and backed by historic landmark rulings of the Supreme Court, the adoption of the national language is presented not merely as a symbolic gesture, but as a fundamental human right and an administrative necessity to ensure transparent, equitable access to justice.
The study critically evaluates the systemic challenges hindering this transition, including colonial mindsets, reliance on complex English legal precedents, dual educational systems, and technological limitations. Furthermore, it delves into technical linguistic barriers such as archaic Arabic/Persian terminology, sentence structure discrepancies, lack of standardization in legal vocabulary, and gaps in modern legislative nomenclature.
To overcome these obstacles, the paper advocates for a phased, pragmatic methodology. Key recommendations include simplifying legal jargon into accessible Urdu, integrating bilingual legal education (LLB), developing specialized digital infrastructure and AI-driven translation tools, and establishing dedicated translation bureaus within superior courts. Ultimately, the paper contends that bridging the linguistic divide between the judiciary and the common citizen is essential to realizing the promise of swift, affordable, and inclusive justice.
